Terms of Service
Welcome to englishwithsue.com (“Website”, “Platform”), operated by a private English teacher (“we”, “us”, or “our”). These Terms of Service (“Terms”) govern your access to and use of the Website, including any courses, lessons, bookings, digital content, subscriptions, student accounts, and related English language teaching services we provide.
By accessing the Platform, creating an account, purchasing a course, booking a lesson, or otherwise using our services, you agree to be bound by these Terms. If you do not agree, do not use the Platform or our services.
1. Services Provided
We provide online English language education and related services, which may include:
- Self-paced online courses and learning materials.
- Private or small-group English lessons.
- Downloadable resources, exercises, and lesson content.
- Student accounts, progress tracking, and course access features.
- Live sessions delivered through third-party platforms such as Zoom, Google Meet, or similar tools.
All educational services are provided according to the course or lesson format made available at the time of purchase or booking. We may modify, improve, replace, or discontinue parts of the Platform or services where reasonably necessary.
2. Eligibility and User Responsibility
By using the Platform, you confirm that you are legally capable of entering into a binding agreement or that you have the involvement and permission of a parent or legal guardian where required.
You agree to provide accurate information and not to:
- Use the Platform for any unlawful, abusive, or fraudulent purpose.
- Impersonate another person or provide false account information.
- Attempt to gain unauthorized access to the Platform, servers, accounts, or related systems.
- Interfere with the normal operation or security of the Platform.
- Share account access with others unless the service explicitly allows it.
3. Accounts and Access
Some parts of the Platform may require you to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
We may suspend, restrict, or terminate access to your account if we reasonably believe you have breached these Terms, used the Platform improperly, or created risk for the Platform, other users, or our business.
4. Bookings, Courses, and Digital Access
Lessons, programs, and paid courses may be offered as one-off purchases, subscription-based access, scheduled sessions, or bundled packages.
- Lessons or services that require scheduling must be booked in advance, subject to availability.
- Access to course content may begin immediately after payment or account activation.
- Some products may have time-limited access periods, renewal terms, or usage restrictions.
- We reserve the right to change course structure, lesson sequencing, platform features, and content presentation without removing the core purchased service.
5. Payments
Paid services on the Platform may include courses, subscriptions, lesson packages, private lessons, and other educational products. All prices are displayed as made available on the Platform or during the booking process.
Payments may be processed through third-party payment providers, including Stripe and PayPal, depending on the payment method or configuration in use at the time.
- Payment must be made in full at the time required for the selected service.
- Your transaction is also subject to the terms and policies of the relevant payment processor.
- We do not store full payment card information on our own servers.
- If a payment fails, is reversed, is disputed, or is charged back, we may suspend course access or services until the matter is resolved.
6. Subscriptions and Recurring Payments
Some services may be offered on a recurring subscription basis. If you purchase a subscription:
- you authorize recurring charges using your selected payment method, where applicable;
- your subscription may renew automatically unless cancelled before the next billing date;
- access to subscription content may be suspended or terminated if payment is not successfully completed.
Any subscription-specific pricing, billing intervals, access terms, or cancellation terms shown at checkout or in the product details form part of these Terms.
7. Cancellation, Rescheduling, and Refunds
Because this Platform includes both digital educational content and live teaching services, cancellation and refund rules may differ depending on the product or service purchased.
Live Lessons and Booked Sessions
- You may reschedule or cancel a lesson with at least 24 hours’ notice.
- Cancellations made with less than 24 hours’ notice may be charged in full and may be treated as a completed session.
- If we need to cancel a booked session, you will be offered either a rescheduled session or a refund for that session, where applicable.
Courses, Digital Content, and Platform Access
- Because digital course access may be provided immediately after payment, refunds for online courses, downloadable materials, or digital access products are not guaranteed.
- Refund requests may be considered on a case-by-case basis where required by law or where exceptional circumstances apply.
- We reserve the right to refuse a refund request where substantial course access, downloads, or usage has already occurred.
8. Student Conduct
When using the Platform or attending lessons, you agree not to:
- engage in abusive, threatening, discriminatory, or disruptive behaviour;
- record lessons without permission where permission is required;
- share paid content, course access, or lesson materials without authorization;
- use the Platform in a way that harms other users or the teacher.
We may suspend or terminate access without refund where serious misuse, abuse, or repeated breaches occur.
9. Intellectual Property
All content on the Platform, including text, branding, layouts, lessons, videos, worksheets, exercises, downloads, course structures, graphics, and teaching materials, is owned by englishwithsue.com or used under appropriate permission, unless otherwise stated.
You may not, without prior written permission:
- copy, reproduce, republish, sell, or redistribute Platform content;
- record, upload, or commercially reuse lessons or materials;
- share paid resources, course downloads, or account access with others;
- modify or create derivative commercial works from our materials.
Lesson materials provided to students are licensed for personal, individual, non-commercial educational use only.
10. Educational Disclaimer
We aim to provide high-quality English language teaching and useful learning tools. However, we do not guarantee any specific outcome, score improvement, job result, fluency level, academic result, or language-learning timeline.
Learning outcomes depend on many factors, including the student’s effort, attendance, consistency, skill level, motivation, practice, and engagement.
11. Third-Party Tools and Platforms
The Platform may rely on third-party providers for payments, hosting, analytics, video conferencing, scheduling, email, authentication, or related technical services.
We are not responsible for outages, policy changes, interruptions, or service failures caused by third-party providers outside our direct control. Your use of such third-party services may also be subject to their own terms and policies.
12. Website Availability and Technical Issues
We do not guarantee that the Platform will always be uninterrupted, error-free, secure, or available at all times. Maintenance, software updates, hosting problems, internet outages, or third-party failures may affect access.
We may perform maintenance, deploy updates, or restrict access temporarily where reasonably necessary for security, stability, or service improvement.
13. Limitation of Liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, consequential, special, or punitive loss or damage arising from or related to:
- your use of, or inability to use, the Platform or services;
- technical interruptions, downtime, delays, or access problems;
- missed lessons, booking issues, or third-party platform failures;
- payment processor issues, delays, reversals, or chargebacks;
- your reliance on educational outcomes not being achieved as expected;
- unauthorized account access resulting from your failure to protect your credentials.
Nothing in these Terms excludes liability that cannot legally be excluded under applicable law.
14. Indemnity
You agree to indemnify and hold us harmless from claims, losses, liabilities, damages, and expenses arising out of your misuse of the Platform, breach of these Terms, violation of law, or infringement of any rights of another person or entity.
15. Privacy
We respect your privacy and handle personal information in accordance with our Privacy Policy. By using the Platform or services, you acknowledge that your information will be collected, used, and processed in line with that policy.
16. Termination
We may suspend or terminate your access to the Platform or services, with or without notice, if:
- you breach these Terms;
- you misuse the Platform or our educational services;
- payment is not received or is reversed;
- continuing to provide service would create legal, operational, or security risk.
Termination does not remove any payment obligations, usage restrictions, or rights that by nature should continue after termination.
17. Changes to the Terms
We may update or modify these Terms from time to time to reflect changes in law, business operations, service offerings, platform functionality, or payment methods.
Updated Terms will be posted on this page with the revised date. Continued use of the Platform or services after updated Terms are posted means you accept the revised Terms.
18. Governing Law
These Terms are governed by the laws of the Republic of South Africa. Any disputes arising out of or connected with these Terms or the use of the Platform will be subject to the applicable legal procedures and jurisdiction of South Africa, unless otherwise required by mandatory law.
